The College of Law at the University of Karbala hosted the Professor of Private International Law at the College of Law at Al-Nahrain University, Assistant Professor Dr. Samah Hadi Hussein, to participate in the discussion committee of a Master’s thesis on the Responsibility of the Host State for Investment for the Residence of Foreign Investors – A Comparative Study, submitted by the student Osama Muhammad Jassim.
The study aimed to demonstrate the suitability of Investment Law No. for the residence of the investor, and whether it regulated it accurately or referred it to the Foreign Residence Law, and whether it distinguished the foreign investor from other foreigners in the matter of entry and residence, in addition to identifying the impact of international agreements and attempts to regulate investment in international legal rules on the internal systems of countries.
The study concluded that the Iraqi legislator has relied on the nationality of the investor to determine his foreign status, and did not address the foreign status of money despite the impact of foreign money on the investment and the investor, in addition to the fact that the foreign investor may enjoy international status for a limited period, and this status enables him to file a lawsuit against any sovereign state with which he has contracted directly without the need for his state to intervene.
